Indecent Exposure Defense in Lafayette

Case-Specific Defense for Louisiana Obscenity Charges

An indecent exposure accusation requires a close review of what allegedly occurred, where it happened, who made the identification, and what evidence supports criminal intent. Precht Law Firm represents people in Lafayette facing sex-crime charges and examines the specific facts behind each allegation.

Led by Attorney Jordan T. Precht, we bring years of experience defending clients in Lafayette sex-crime cases. Jordan develops a direct relationship with each client, remains accessible, and explains important developments as the case moves forward. You won’t be left guessing about the charge, your options, or the next step.

What Louisiana Obscenity Law Requires

Louisiana generally addresses indecent exposure through its obscenity statute, La. R.S. 14:106. Under subsection A(1), prohibited conduct can include intentionally exposing the genitals, pubic hair, anus, vulva, or female breast nipples in a public place, a place open to public view, or a prison or jail.

Exposure alone doesn’t establish every element of a criminal charge. The prosecution must also prove a specified intent, such as an intent to arouse sexual desire, appeal to a prurient interest, or engage in conduct considered patently offensive. A prurient interest is an excessive or shameful interest in sexual matters.

Important issues under the Louisiana obscenity statute can include:

  • Location: Whether the alleged conduct occurred in a public place, was open to public view, or happened in another location covered by the statute.
  • Visibility: What another person could actually see and from what position or distance.
  • Intent: Whether the circumstances support the specific sexual or prurient intent required by the charged provision.
  • Conduct: Whether the alleged act matches the conduct prohibited by the statute.

Subsection B states that lack of knowledge about an alleged victim’s age or marital status isn’t a defense. That rule doesn’t remove the prosecution’s obligation to prove every required element of the charge beyond a reasonable doubt.

How We Review an Indecent Exposure Charge

Our review begins with the accusation and the evidence behind it. We examine the charging documents, police reports, witness statements, video evidence, and other available materials with the accused person. This process can reveal conflicts between the prosecution’s account and the available evidence.

Intent & Circumstances

We examine whether the evidence supports intentional exposure and the criminal intent required by the relevant provision. The setting, the accused person’s actions, statements attributed to those involved, and the sequence of events may all affect that analysis. An accidental or misinterpreted event raises different issues from conduct supported by evidence of a prohibited purpose.

Identification & Witness Credibility

Identification can be disputed when an event happened quickly, visibility was limited, or a witness observed the person from a distance. We assess how the identification was made and whether later accounts remained consistent. We also consider each witness’s opportunity to observe and whether objective evidence supports the account.

Video & Other Evidence

Video may clarify an allegation, but its meaning depends on what the recording actually shows. Camera position, image quality, missing footage, and timing can affect its value. Other evidence may provide context that isn’t apparent from a single image or witness statement.

We present a bold and aggressive defense while keeping clients informed. Our documented sex-crime results include an acquittal in State of Louisiana v. Moreno and charges dismissed before trial in the cases against Perry, T. Taylor, and Woodward. Past results don’t determine the outcome of another case, but they reflect our experience examining and contesting serious allegations.
