How Louisiana Law Defines Drug Distribution Charges
The Louisiana Uniform Controlled Dangerous Substances Law establishes five drug schedules. Louisiana Revised Statutes 40:966 through 40:970 address prohibited conduct involving substances in those schedules, including distribution and possession with intent to distribute.
For example, Louisiana Revised Statutes 40:967(A) prohibits knowingly or intentionally distributing a Schedule II controlled dangerous substance or possessing one with intent to distribute it. Other schedules and substances fall under different provisions. Potential sentencing can vary based on the substance, amount, prior convictions, alleged location, and other case-specific facts.
Simple possession, distribution, manufacturing, and possession with intent to distribute aren’t interchangeable charges. Terms such as drug trafficking also don’t replace the offense identified in the charging document.
